These Terms and Conditions (“Terms”) govern your use of the Golden Hour Education website and your participation in Golden Hour’s courses and services. They constitute a binding agreement between you (the student or site user) and Golden Hour Education (“Golden Hour,” “we,” or “us”). Please read them carefully. By accessing our website or enrolling in a course, you agree to be bound by these Terms, as well as all applicable laws and regulations . If you do not agree with any part of these Terms or our other policies, you should not use our site or services.
For clarity, “Services” includes our in-person training classes, blended (online/in-person) courses, digital materials, and any related offerings. The Privacy Policy and Refund Policy described above are incorporated into these Terms by reference (your agreement to these Terms signifies your agreement to those policies as well).
The explanations and information provided on this page are only general and high-level explanations and information on how to write your own document of Terms & Conditions. You should not rely on this article as legal advice or as recommendations regarding what you should actually do, because we cannot know in advance what are the specific terms you wish to establish between your business and your customers and visitors. 1. Course Registration and Payments

Eligibility: Our courses are generally open to individuals 18 years or older. Minors (typically ages 16-17) may be allowed to enroll in certain courses with parental/guardian consent; please check with us for specific age restrictions. We do not knowingly collect personal information from children under 13 without parental consent .

Account and Information: When you register for a course or create an account on our site, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account . If you become aware of any unauthorized use of your account, notify us immediately. We are not liable for any loss or damage arising from your failure to secure your account.

Payment: Course fees must be paid in full at the time of registration (unless an installment plan or invoice billing has been explicitly arranged). By providing payment information, you represent that you are authorized to use the payment method and you authorize us (or our payment processor) to charge the full amount of the course fees and any applicable taxes or fees. All payments are processed in USD (unless otherwise noted) and are subject to our Refund Policy above.

Confirmation: Your seat in a class is not guaranteed until payment is successfully processed and you receive a registration confirmation. We reserve the right to refuse or cancel a registration at our discretion, for example, if a class is full, if you do not meet prerequisites, or in cases of mispricing. If we cancel a registration, you will be entitled to a refund of any fees paid, unless the cancellation was due to your violation of these Terms.

Prerequisites: Some advanced courses require proof of prerequisites (e.g., a current Basic Life Support certification might be required before taking an Advanced Cardiac Life Support course). It is your responsibility to ensure you meet all listed prerequisites before enrolling. If you register without a required prerequisite, we reserve the right to cancel your enrollment (with a refund per the Refund Policy) or transfer you to a more appropriate course. We are not responsible if you enroll in a course that does not meet your professional requirements. Please double-check that you are selecting the correct course (e.g., BLS vs. CPR, provider level vs. instructor level, AHA vs. Red Cross) before registration . If you are unsure, contact us for guidance before signing up.

2. Student Conduct and Safety

Attendance: You must attend all scheduled class sessions (and complete any required online modules for blended courses) to be eligible for certification. Prompt attendance is expected; arriving late or leaving early may result in non-completion of the course with no certificate (and no refund, per policy). Instructors have discretion to deny entry to late participants as noted in the Refund Policy.

Behavior: We are dedicated to providing a positive, safe learning environment. Students are expected to behave professionally and respectfully toward instructors and fellow participants. Harassment, discrimination, disruptive behavior, or illegal conduct will not be tolerated. Golden Hour reserves the right to remove any student from a class for inappropriate or dangerous behavior. If you are removed for misconduct or violations of these Terms, you will not be entitled to any refund or compensation, and you may be barred from attending future courses.

Safety and Physical Activity: Some courses (e.g., CPR training) involve moderate physical activity, such as kneeling on the floor, performing chest compressions, or participating in simulations. By enrolling, you acknowledge these activities and assume responsibility for determining your ability to participate. You are required to inform the instructor of any physical limitations, injuries, or conditions that might affect your participation. We will make reasonable accommodations under our Accessibility policy (see Accessibility Statement below) for disabilities. All students must follow the safety instructions given by the instructor. If at any point you feel discomfort or need to pause during a skills practice, you must inform the instructor immediately. You participate in the physical components of training at your own risk, but note that all activities are designed to be safe when done correctly. Golden Hour is not liable for common training-related aches or minor injuries; by participating, you release us from liability for such ordinary risks. (In the unlikely event of a serious injury or medical emergency during class, we will seek appropriate medical attention without delay.)

Course Materials and Exams: Course materials (texts, workbooks, online content) provided to you are for your personal educational use. You may not copy or distribute these materials to others (see Intellectual Property below). If a course has a written exam or skills test, you must complete it yourself without unauthorized assistance. Cheating or fraudulently obtaining certification is strictly prohibited and is grounds for immediate expulsion with no refund, as well as possible reporting to certifying authorities.

Completion and Certification: Successful completion requirements (such as passing scores or skill demonstrations) will be communicated at the start of the course. While our instructors will do their best to help students succeed, certification is not guaranteed. You must meet the performance standards to earn a certification. If you do not pass, you may need to retake the course or exam (additional fees may apply for retakes or remedial sessions, at our discretion). No refund is provided if you fail to achieve certification, since the fee covers the training provided. We can often offer guidance on additional practice or a discounted re-enrollment in a future class, so please discuss options with your instructor.

3. Intellectual Property and Limited License

All content provided by Golden Hour Education – including our website content, course materials, manuals, videos, images, logos, and any other intellectual property – is owned by Golden Hour or used under license. These materials are protected by copyright, trademark, and other intellectual property laws.
When you enroll in a course or use our site, we grant you a limited, non-transferable, non-exclusive license to access and use the materials for your personal, non-commercial educational use only . This means you may download or print materials we provide only for your own study and reference. You may not do any of the following without our express written permission:

Copy, reproduce, or distribute course materials or website content (either to the public or to other people who have not registered), except for uses permitted under copyright law (such as brief quotations for review).

Modify, translate, or create derivative works based on our materials.

Record or video any in-person class without prior permission. (We sometimes allow photos or short videos for personal use – ask your instructor about the policy for your class.)

Use our company name, logos, or trademarks in any unauthorized way, such as advertising your own services, without permission.
Your license to use our site and materials will automatically terminate if you violate these restrictions, and we may deny you further access to our content . Upon completion of a course (or earlier termination of your access), you should destroy any downloaded course materials unless you have our permission to retain them. (For clarity: of course you may keep your completion certificate and any notes you took during class. This clause mainly applies to proprietary teaching materials or exam content.)

4. Limitation of Liability

To the maximum extent permitted by law, Golden Hour Education (and its owners, employees, and agents) shall not be liable for any indirect, special, incidental, or consequential damages arising out of or related to your use of our website or participation in our courses . This includes, without limitation, any personal injuries, property damage, lost profits, lost data, business interruption, or other losses, even if we have been advised of the possibility of such damages. Our services are provided for educational purposes, and while we strive for high quality and safety, we cannot be responsible for events outside our control or how you later use the training.
Golden Hour’s total aggregate liability for any claim arising from or related to a course or the use of our services is limited to the amount you paid for that course or service. By enrolling, you agree that this limitation of liability is reasonable and appropriate given the nature of the services.
Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so portions of these limitations may not apply to you . In such cases, our liability will be limited to the fullest extent permitted by applicable law.

5. Disclaimer of Warranties

All our services, courses, and website content are provided “as is” and “as available,” without warranty of any kind. Golden Hour disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement . We do not guarantee that our training will meet any specific requirements you may have, or that you will achieve any particular result (such as passing an external exam or getting a job) by using our services. While we endeavor to keep our website and materials up-to-date and accurate, we make no representations or warranties about the accuracy or completeness of any information or content .
We cannot promise that our website (or online training platform) will be available at all times or free of errors, viruses, or other harmful components, though we take reasonable measures to maintain security and functionality. You use our website and services at your own discretion and risk.

6. Indemnification

You agree to indemnify, defend, and hold harmless Golden Hour Education, its owners, officers, instructors, employees, agents, and affiliates from and against any and all claims, liabilities, losses, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of our website or services; (b) your violation of these Terms or any policy referenced herein; or (c) your violation of any third-party right or applicable law . This means if a third party (or other student) brings a claim against us due to your conduct, content, or negligence, you will cover the costs and damages for us. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in defending such matter.

7. Miscellaneous Provisions

Changes to Terms: Golden Hour may update or modify these Terms from time to time. If we make material changes, we will notify users via the website or email. The latest version of the Terms will always be available on our website, with the “Last Updated” date. By continuing to use our services after changes become effective, you agree to the revised Terms. If you do not agree, you must stop using the services.

Termination of Services: We reserve the right to terminate or suspend your access to our website or remove you from a course for violations of these Terms or any policy, or for any behavior that we deem harmful to our interests or others’ safety. We may also terminate accounts that have been inactive for an extended period or in response to legal requirements. If your access is terminated and you believe it’s a mistake, please contact us. Note that termination for cause (e.g., misconduct) does not entitle you to a refund.

Governing Law and Dispute Resolution: This agreement and any disputes arising from it or from your use of our services are governed by the laws of the State of California, without regard to its conflict of law principles. You agree that any dispute or claim will be resolved in the state or federal courts located in the County of [Los Angeles], California, and you consent to the personal jurisdiction of such courts.
